Terms of Service
These Terms govern your access to and use of the Hyperouter website at hyperouter.app, the Hyperouter API, Hyperouter Chat and related services (together, the “Service”), provided by Hyperouter (“Hyperouter”, “we”, “us”). Please read them carefully.
1. Agreement
By creating an account, requesting or using an API key, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you use the Service on behalf of an organization, you confirm you are authorized to bind that organization, and “you” refers to it. You must be at least 18 years old, or the age of majority where you live, to use the Service.
2. Accounts and API keys
- You must give accurate account information and keep it up to date.
- API keys are credentials. Keep them confidential and do not embed them in client-side code. You are responsible for all usage and charges made with your keys, including unauthorized usage, until you ask us to revoke them.
- Notify us promptly at account@hyperouter.app if you believe a key has been exposed.
3. The Service
Hyperouter provides a single interface for sending requests to large language models operated by third parties (“Model Providers”). When you send a request, we route it to a Model Provider according to our routing logic and any preferences you set, and return the provider’s response to you.
We do not create, train or control the models, and we do not review outputs before they are returned. Model availability, capabilities and prices are set by Model Providers and can change at any time. We may add or remove models and venues without notice.
4. Credits, fees and payment
- Prepaid credits. Usage is paid from a prepaid balance of credits denominated in US dollars. Requests are charged at the Model Provider’s list price for the tokens processed, as shown by our Models API at the time of the request.
- Top-up fees. A fee is added when you purchase credits: 3.0% for card payments and 2.5% for USDC or USDT. Fees are shown before you confirm a purchase.
- Failed requests. Requests that fail on every venue are not charged. For streamed responses that stop partway, you are charged only for tokens delivered.
- Refunds. Unused credits may be refunded on request within 30 days of purchase, less the top-up fee and any payment processor charges. Crypto top-ups are refunded in the same asset to the originating address, less network fees. Otherwise credits are non-refundable except where required by law.
- Expiry. Credits do not expire while your account is in good standing. Credits are non-transferable and have no cash value outside the Service.
- Taxes. Prices exclude taxes. You are responsible for any taxes that apply to your purchases, other than taxes on our income.
- Chargebacks. If a payment is reversed, we may suspend the account until the balance is settled.
5. Acceptable use
You agree not to use the Service to:
- break any law, or infringe or misappropriate anyone’s rights;
- generate or distribute child sexual abuse material, or content that sexualizes minors;
- develop weapons capable of mass casualties, or plan or promote violence;
- create malware, attack systems, or gain unauthorized access to data or networks;
- defraud, impersonate or deceive people, including undisclosed automated messaging at scale;
- violate the usage policies of the Model Provider serving your request;
- resell raw API access or share keys outside your organization without our written consent;
- probe, overload or interfere with the Service, or work around rate limits or billing.
Model Providers may apply their own content filters. A request refused by a provider is not a breach of these Terms by us.
6. Your content
You keep all rights to the prompts, files and other inputs you send (“Inputs”) and, as between you and us, to the outputs you receive (“Outputs”). You grant us a limited license to process Inputs and Outputs only as needed to provide, secure and bill for the Service, including passing them to the Model Provider that serves your request.
We do not store Inputs or Outputs after a request completes unless you turn on logging. We do not use your content to train models. See the Privacy Policy for details. You are responsible for your Inputs and for how you use Outputs, and for checking Outputs for accuracy before relying on them.
7. Model Providers
Each Model Provider processes your request under its own terms and data policies. By routing to a provider, you agree to comply with that provider’s usage policies. You can restrict which providers receive your requests using routing settings, including limiting routing to providers that do not retain data. We are not responsible for the acts or omissions of Model Providers.
8. Beta features
Features labeled beta, preview or early access, including Hyperouter Chat and the API during private beta, are provided for evaluation. They may change or be discontinued, may be less reliable, and are excluded from any uptime commitment.
9. Suspension and termination
You may stop using the Service at any time and ask us to close your account. We may suspend or terminate access if you breach these Terms, if your use creates security or legal risk, or if required by law. Where reasonable we will give notice first. On closure, remaining credits will be refunded less applicable fees, unless the account was terminated for fraud or a serious breach of Section 5.
10. Disclaimers
THE SERVICE AND ALL OUTPUTS ARE PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY THAT OUTPUTS ARE ACCURATE, COMPLETE OR SAFE. AI outputs can be wrong. Do not rely on them as professional, legal, medical or financial advice.
11. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, HYPEROUTER WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA OR GOODWILL. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AND (B) US$100. These limits do not apply where they are prohibited by law.
12. Indemnity
You will defend and indemnify Hyperouter against third-party claims, and related losses and costs, arising from your Inputs, your use of Outputs, or your breach of these Terms.
13. Changes to these Terms
We may update these Terms. For material changes we will give at least 14 days’ notice by email or on this page before they take effect. Continuing to use the Service after that means you accept the updated Terms.
14. General
These Terms are the entire agreement between you and us about the Service and replace any earlier understanding. If any part is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets. These Terms are governed by the laws of the jurisdiction in which Hyperouter is organized, without regard to conflict-of-law rules, and disputes will be resolved in the courts of that jurisdiction unless applicable law requires otherwise.
